Leaving the Masjid after the Call to the Prayer has been made
Question:
A man went to pray Fajr then left straight away after the Adhān (call to the prayer), is the prohibition of leaving after the Adhān applicable to him?
Answer:
Muslim reported in his ‘Sahīh‘ on the authority of Abu Ash-Sha’thā’, to have said:
“We were siting in the Masjid with Abu Hurayrah and the caller to the prayer performed the call, then a man stood up and left the Masjid, Abu Hurayrah followed him with eyes until he left and said:
“As for this one, he has disobeyed Abul-Qāsim ﷺ.”
In this hadeeth is the prohibition of leaving the Masjid after the call of the prayer has been made.
An exception to this is made if the departure was due to a legislated excuse, as a reconciling combination of the evidences.
For example if his departure was:
➖For the removal of a state of impurity.
➖Or something occurred which makes him want to change to a prayer in another Masjid, and if he thought he could catch the Iqāmah (call to the start of the prayer) there.
➖Or due to a necessity which permits to be excused from attending the congregational prayer.
And other than these of legislative excuses.
[Upon this was the action of the people of knowledge from the Companions of the Prophet ﷺ and those after them, that one does not leave the masjid except he who is excused due to not having ablution or an affair which is a must]
As mentioned by Imaam At-Tirdmidhi in his ‘Sunan‘.
It’s also a must that attention is payed to the affair of many of the Masajid in many countries, in what relates to their calling to the prayer before the entrance of the true Fajr, so their call to the prayer is not included in the prohibition of exiting the Masjid after the call to the prayer.
Shaykh-Ul-Islām, may Allāh have mercy upon him, as found in “Al-Fatāwal Kubrā“, said:
“Exiting the Masjid after the call to the prayer has been made is discouraged, is it impermissible or disliked, the subject has two angles, except if the call to the Fajr prayer was before its time, then it’s not disliked and this has been mentioned by Ahmad.”
