Question:

What’s the ruling on photography, there is some differing on it not containing any imitation of Allah and it not being something created by a person’s hand.

Answer:

Imitation is taking place due the title picture taking also applying to photography, as it falls under the generality of the evidences prohibiting picture taking.

It’s not possible to mention all of them here.

Find some of them at the website of Imām Ibn Bāz under a question with the same wording.

As for that it’s not something created by human hands then this is not correct.

The one who made the device used for photographing is a human being, and he is the one who is using the device.

Similar to the pen being created by a human and he is the one who is drawing pictures with it.

So the ruling revolves around the critirium, in presence and in lack thereof.

And the difference in the two devices in type and the sophistication of the device, do not negate the impermissibility.
