Giving zakāt to ones parents and children

Question:

A person gave his parents’ zakāt to his sister without knowing the ruling or telling her it was their parents’ zakāt, so what does he have to do?

Answer:

He replaces this zakāt because the zakāt given to parents and above (i.e. grand-parents etc.) and children and below (i.e. grand-children etc.) is invalid. Zakāt cannot be given to parents or children and a consensus was relayed in regards to that.

But if one of the children gets married, for example the daughter is married and her husband is poor, according to a group of the scholars it is OK for her to be given from her father’s zakāt, and from her son’s zakāt also, if he is from a different husband and the mother has re-married because it is the husband that is obligated to provide.

The Māliki’s – may Allāh have mercy upon them – say if the husband is incapable, the expenses go back to the father and so because it is now wājib for him to pay for her needs he cannot give her from his zakāt.

The Shāfis say the expenses go from the father to the husband regardless of his capability and that because there are no expenses upon the father there is nothing wrong with him giving her from his zakāt, and this is a strong statement.
