The ruling on the one who caused the death of a person by injection
Question:
An old woman was sick so her son went to the doctor and explained to him the symptoms of his mothers sickness, so the doctor gave him an injection needle, so the son took the needle and gave it to a layman amongst us in the town who didn’t study medicine but he used to inject some sick people and no harm happened to the sick people, so when the layman injected the old woman with the needle according to what the doctor said the old lady waited for an hour or two then died. Is there anything of expiation or such upon that layman?
Answer:
Some people are struck with sensitivity, it’s not enough that someone is good at injecting while not paying attention to what relates to experimenting that sickness before the injection, and some people perhaps he leaves the bubbles in-between the needle, he doesn’t take them out, so if the one who injected was the cause for the likes of this, then yes, upon him is expiation which Allaah mentioned in his Book, expiation of killing by mistake, and also the one who ordered him to inject her also was a cause, being that he dealt with her treatment with that which was not necessary, so it had an affect on the woman, it affected her because it was treatment that was not suitable for the sickness, so it backfired, so it likewise it falls also on the one who was the (initial) cause.
