Conditions of dire necessities (الضروريات)

Dire necessities (الضروريات)

Shaykh Ibn ‘Utheymeen, may Allah have mercy upon him, said:

“Dire necessity permits the prohibited, but with two conditions:

1- That one is forced to a specific prohibited affair and doesn’t have another option that which he can repel the necessity with. If he found other than it (i.e from the halaal) then it’s not permissible for him (to take what’s prohibited).

2- That the necessity is repelled with it, for verily if it is not repelled then it remains upon its ‘Asl (the original state) of unlawfullness, and if it is doubted (prohibited action not repelling the necessity) then it also remains unlawful (to perform that prohibited action).

That is because performing the prohibited is a certain evil. And the repelling of the necessity with it is doubted.
So a known clear evil is not perpetrated for something which is doubted.”
