Ruling on Mother Gifting her wealth Unequally Among Children?

Answered by our Shaykh, the ‘Allāmah, the Trustworthy Advisor, Abu ‘Abdirrahmān Yahya bin ‘Ali Al-Hajūri – may Allāh preserve him – on the 27th, Dhūl-Hijjah, 1441H

Question:

A mother gifted one of her kids from her wealth and not the rest of her kids with the proof that she lives with him, so is anything upon the mother?

Answer:

There is an elaboration in this, if he up kept taking care of her, and honoring her, and spending upon her, which the rest do not do, then when he takes it, it’s in return for his effort he exerted.

So if she gave him something in return for his effort there is nothing upon her, but if she gave him extra out of anger of the rest of the children, or in order to make them angry then this is not allowed for her

(إتقوا الله واعدلوا بين أولادكم)

“Fear Allāh and be just amongst your children.”
