Ruling on touching the Mushaf without Wudhu

Benefit: Commentary on the statement of Shaykh Al-Islaam:

That the intent with it is the scrolls that are in the hands of the Angels from numerous angles:

Shaykh Al-Islaam – may Allaah have mercy on him – said as comes in Al-Mustadrak upon ‘Majmoo’ Al-Fataawa’ (1/169): …. And our Shaykh said: “The statement of Ahmed in returning to the statement of the Taabi’een is general in the Tafseer and other than it, and I heard Shaykh Al-Islaam Ibn Taymiyyah – may Allaah sanctify his soul – saying:

“The correct opinion from it is what the wording points towards in its indication from the angle of analogy of precedence, he said: “And the correct opinion in the verse:-

(لَّا يَمَسُّهُۥٓ إِلَّا ٱلْمُطَهَّرُونَ)

“None touch it except the purified [i.e., the Angels].” [Al-Waaqi’ah: 79]

Is that the intent with it is the scrolls that are in the hands of the Angels from numerous angles:

From it: It’s description that it is

(فِى كِتَٰبٍ مَّكْنُونٍ)

“In a Register well-protected;” [Al-Waaqi’ah: 78]

And (مكنون) – Al-Maknoon is that which is covered from the naked eye, and this verily is in the scrolls which are in the hands of the Angels.

And from it: That He said:

(لَّا يَمَسُّهُۥٓ إِلَّا ٱلْمُطَهَّرُونَ)

“None touch it except the purified [i.e., the Angels].” [Al-Waaqi’ah: 79]

And they are the Angels, and if He intended those who have wudhu’, He would of said (المتطهرون) – Al-Muttatahiroon, for the Angels are Mutahiroon (pure within themselves), and the believers are Muttatahiroon (purified by other than themselves).

And from it: That this (إخبار) – informing, even if it was a prohibition, He would of said: (لا يمسسه) – Laa yamsashu with jazm, and the origin in (الخبر) – Al-Khabr is to be Khabr in structure and meaning.

And from it: That this is a refutation upon the one that says: Indeed the Shaytaan came with this Qur’aan, so He Ta’aala informed that it is:-

(فِى كِتَٰبٍ مَّكْنُونٍ)

“In a Register well-protected;.” [Al-Waaqi’ah: 78]

The Shayaateen can’t touch it, and there is no means for them to reach it, as He Ta’aala said in Surah Ash-Shu’aaraa;

(وَمَا تَنَزَّلَتْ بِهِ ٱلشَّيَٰطِينُ * وَمَا يَنۢبَغِى لَهُمْ وَمَا يَسْتَطِيعُونَ)

“And the devils have not brought it [i.e., the revelation] down. It is not allowable for them, nor would they be able.” [Ash-Shu’araa’: 210-211]

And verily only the pure souls can get to it, and they are the Angels.

And from it: That this is similar to the verse which is in Surah Abasa:-

(فَمَن شَآءَ ذَكَرَهُۥ * فِى صُحُفٍ مُّكَرَّمَةٍ * مَّرْفُوعَةٍ مُّطَهَّرَةٍۭ * بِأَيْدِى سَفَرَةٍ * كِرَامٍۭ بَرَرَةٍ)

“So whoever wills may remember it. [It is recorded] in honored sheets, Exalted and purified, [Carried] by the hands of messenger-angels, Noble and dutiful.” [‘Abasa: 12-16]

Imaam Maalik said in his ‘Muwatta’:

“The best that I’ve heard concerning the Tafseer of His statement:-

(لَّا يَمَسُّهُۥٓ إِلَّا ٱلْمُطَهَّرُونَ)

“None touch it except the purified [i.e., the Angels].” [Al-Waaqi’ah: 79]

That it is like this verse which is in Surah Abasa.”

And from it: That the verse is Makki (revealed in Makkah) from a Surah which is Makkiyyah, it includes affirmation of Tawheed and Prophethood and the Last Day and affirmation of the Creator and refutation on the Kuffaar, and this meaning (speech concerning the Angels) is more suitable in intent than a subsidiary action, which is the ruling on a person in the state of impurity touching the Mushaf.

And from it: That had it intended the Book which is in the hands of the people, there would not of been any major benefit in the swearing and oath upon that with this great swearing; As from what is well known is that every speech in a book is acceptable to be the truth or falsehood, in contrary to an oath which is sworn upon that it is a protected Book with Allaah covered from the naked eye, no Shayaateen can reach it, nor can he take from it, nor can any touch it, except pure souls.

So this meaning is more suitable and more noble and befitting with the verse and takes more precedence without a doubt.

So you heard Shaykh Al-Islaam Ibn Taymiyyah – may Allaah sanctify his soul – saying:

“But rather the verse points to with an indication that none touch the Mushaf except one in a state of purity; because if none touch those scrolls except those pure within themselves due to the blessing of Allaah upon them; then this Mushaf takes precedence that none touch it except those in a state of purity.”
