Getting Married with Haraam Money
Question:
The Questioner says: Is it allowed to get married with money earned from ‘Khat’ (A narcotic herbal drug) if there is no other money?
Answer:
I advise you to get married with money that is halaal in order for you to obtain blessing in this marriage; and to avoid this money.
But if you fear upon yourself fitnah and that you may fall into fornication then this is the lesser of two evils; get married with this money and the marriage is valid due to the separation of the two affairs (i.e. how the money was earned and the mahr itself)
However, do not resort to this unless
you have despaired from (gaining) lawful money and fear fitnah and harm upon yourself.
You are like the one who performs Hajj from this money. It is not befitting for a person to perform Hajj from unlawful money to begin with.
إِنَّ اللَّهَ طَيِّبٌ لَا يَقْبَلُ إِلَّا طَيِّبًا
Verily Allah is Good and does not accept other than good.
[Narrated by Abou Hurreira in Muslim: Hadith Number 1015]
However, if he performed Hajj then the Hajj is valid due to the separation of the two affairs (i.e. the money used to perform Hajj and the actions of Hajj itself); especially as the actions of Hajj are done with the body. All of it are actions done with the body from standing at Arafat and from tawaaf etc. The actions of Hajj have no connection to the money; it is just a means to get there.
A lot of people have been afflicted by this trial, their families, most of them if not all them have been afflicted with this Khat, especially here in Yemen.
Those who have been afflicted by these farms are many and their good, steadfast children are perhaps uncomfortable eating and getting married from this wealth amongst other things. However, the father has nothing except this so they are met with real difficulty.
