Question:
What are the countries which are waajib to make hijrah from?
Answer:
The lands of disbelief which one is unable to establish his religion in.
So it is waajib to leave the lands of disbelief if one has the ability to leave and migrate unto Allah ﷻ and his messenger ﷺ and migration to goodness and to a land of Islaam which one is able to establish his religion in. This is the origin, that hijrah is moving from a land of disbelief to a land of Islaam, this is the origin. So the one who is unable to reside in the lands of the disbelievers, and what I mean by that is, he is not able to establish his religion in it, then it is waajib upon him to leave. It is waajib to leave if he has the ability as mentioned by Allah ﷻ says:
(إِنَّ الَّذِينَ تَوَفَّاهُمُ الْمَلَائِكَةُ ظَالِمِي أَنْفُسِهِمْ قَالُوا فِيمَ كُنْتُمْ ۖ قَالُوا كُنَّا مُسْتَضْعَفِينَ فِي الْأَرْضِ ۚ قَالُوا أَلَمْ تَكُنْ أَرْضُ اللَّهِ وَاسِعَةً فَتُهَاجِرُوا فِيهَا ۚ فَأُولَٰئِكَ مَأْوَاهُمْ جَهَنَّمُ ۖ وَسَاءَتْ مَصِيرًا)
Verily! As for those whom the angels take (in death) while they are wronging themselves (as they stayed among the disbelievers even though emigration was obligatory for them), they (angels) say (to them): “In what (condition) were you?” They reply: “We were weak and oppressed on earth.” They (angels) say: “Was not the earth of Allah spacious enough for you to emigrate therein?” Such men will find their abode in Hell – What an evil destination!
[Surat An-Nisa: 97]
(إِلَّا الْمُسْتَضْعَفِينَ مِنَ الرِّجَالِ وَالنِّسَاءِ وَالْوِلْدَانِ لَا يَسْتَطِيعُونَ حِيلَةً وَلَا يَهْتَدُونَ سَبِيلًا)
Except the weak ones among men, women and children who cannot devise a plan, nor are they able to direct their way.
[Surat An-Nisa: 98]
(فَأُولَٰئِكَ عَسَى اللَّهُ أَنْ يَعْفُوَ عَنْهُمْ ۚ وَكَانَ اللَّهُ عَفُوًّا غَفُورًا)
For these there is hope that Allah will forgive them, and Allah is Ever Oft Pardoning, Oft-Forgiving.
[Surat An-Nisa: 99]
Then Allah ﷻ mentions the muhaajiroon and praises them:
(وَمَنْ يُهَاجِرْ فِي سَبِيلِ اللَّهِ يَجِدْ فِي الْأَرْضِ مُرَاغَمًا كَثِيرًا وَسَعَةً ۚ وَمَنْ يَخْرُجْ مِنْ بَيْتِهِ مُهَاجِرًا إِلَى اللَّهِ وَرَسُولِهِ ثُمَّ يُدْرِكْهُ الْمَوْتُ فَقَدْ وَقَعَ أَجْرُهُ عَلَى اللَّهِ ۗ وَكَانَ اللَّهُ غَفُورًا رَحِيمًا)
So making hijrah from the lands of the disbelievers to the lands of the believers is waajib for the one who is unable to establish his religion, except the weak ones amongst the men and women for they are excused.
[Surat An-Nisa: 100]
And some of our scholars advise with fleeing with your religion without making the intention of hijrah as there are no countries right now who are capable of accepting the muhaajiroon. So perhaps if he leaves and makes hijrah, he could get returned at the airport, or he gets returned after settling in, as is the case in some countries. So he gets returned and it is said to him “we don’t want anyone (muhaajiroon) in our country”. And he’s a muhaajir!! So he has no idea where to turn to. Then perhaps he wants to go to a different country and the same thing is said to him “we don’t want anyone”. And because of this he becomes tired and becomes forced to return to his country. And this why some of our scholars like Sheikh Muqbil and Sheikh Yahya say that he leaves with the intention of fleeing with his religion without making the intention of hijrah.
However, that which is apparent to me is that if he makes hijrah then this is good, and if he is forced to return back then this is a case of necessity and he is not sinful if he is forced and returned back to the country he made hijrah from, there is no sin upon him, and as soon as he finds a way out then he leaves, and he shouldn’t feel at ease to remain there, as soon as he finds an opportunity to leave then he should leave, as soon as he finds another country he is able to establish his religion in, he should leave straight away. However, this is a case of necessity and it should be dealt with as a necessity, so one shouldn’t surpass the boundaries and say:
“Khalaas they’ve sent me back”
This is a land of hijrah so it is not allowed to reside in it. However, you are forced and you couldn’t find another muslim country to establish your religion in. They took you out of the countries that you wanted, so you return to your country. And don’t wish to remain there, it is the only case of necessity.
So make the intention of hijrah. And hijrah it’s reward is great, it’s reward is great!!
And this shouldn’t be an obstacle in intending hijrah and Allah knows best that the individual he fears to be returned. And if they return you, then Alhamdulillah you were forced, What can you do?
There were conditions laid upon the prophet ﷺ from the kufaar that whoever was to come to him from the Muslims that he would send them back to them, And when these companions came to the prophet ﷺ they made hijrah and he still sent them back because of the conditions that were set on him, they were not sinful if they were sent back and they made hijrah to the prophet ﷺ in medina, and he said:
“I am not able (to do anything) there is a contract between us”
So he ﷺ returned them to the land that they made hijrah from. As soon as they found an opportunity to leave they left.
As for the companion Abu Baseer then he didn’t return to makkah, rather he went to river bank and worked with his courage and bravery that even the prophet ﷺ said, praising him:
“..ويل أمه مسعر حرب لو كان له أحد”
Woe to his mother stirrer up of war, that he would have any kinsfolk.
A hero from the heroes. He was not happy to return to makkah, so he went to the river bank and he would deliver poems of Quraish, and likewise, there were those who joined him from his brothers in Islaam.
And likewise the countries of innovations which one is not able to establish his religion in and establish acts of sunnah in, for verily Al-Imaam Maalik gives the legal verdict of the permissibility of making hijrah from countries where the innovations are in control and have the upper hand. So one is unable to make the sunnah apparent nor declare something being sunnah, so there is no problem to leave to a country of sunnah from this land of innovations even if it is a land of Islaam. However, the innovations have the upper hand so if he leaves to another place and makes the intention of hijrah then there’s no problem with this.
This is the fatwa of Al-Imaam Maalik (May Allah have mercy on him) that he sees the permissibility of leaving a place of innovations to a place of sunnah, like now, for example, the country of the Raafidah those evil people who have taken over some places, so if one was to leave such places and makes an intention for hijrah then he is not sinful due to him being under the control of the Raafidah. However, we advise that he leaves with the intention of fleeing with his religion only, due to him being under their control, because they won’t last. And they will be gone with the permission of Allah.
However, if they get the upper hand in the country and there are given a place where they can live in and they have their own official government which is acknowledged, then this is a test upon the Muslims, I swear by Allah if this were to happen then it will be a big affliction!! So upon the Sunni to leave as he is not able to establish any sunnah in it if the Raafidah were given a place to stay.
They will make apparent that they have good relations in the beginning just so the people like them, then if they manage to get the upper hand they will start to harm the people, if not apparently they will do it behind closed doors. Going to the houses of the people and harming this one and abducting this one etc. And you won’t even know where the person went, similar to the acts of the socialists. They won’t make their oppression and injustice apparent they will attempt to hide it.
They are evil people!!
Living with them is difficult!!
