The ruling on eating from the meat slaughtered after the death of someone?
Question:
If a person dies, they slaughter after his death, what is the ruling on eating this food?
Answer:
Food which is from slaughtering at death,
اصْنَعُوا لآلِ جَعْفَرٍ طَعَامًا
“Prepare food for the family of Ja’far…”
And this is opposite to what has come in the Hadith, which has been criticised, in it is weakness as you all know, but the majority are upon it, and from what aids it is that the Prophet ﷺ said:
التَّلْبِينَةُ مَجَمَّةٌ لِفُؤَادِ الْمَرِيضِ تُذْهِبُ بَعْضَ الْحُزْنِ
“Talbeenah (porridge) gives comfort to the heart of the patient and rids some of the grief.”
So they used to make Talbeenah for those in sorrow and for the household of the deceased and what is the likes of that cooperating with them and supporting them in what they are in from sorrow, and assisting them in repelling that sorrow upon them.
This takes more precedence than them the family of the deceased being the ones who slaughter, and perhaps the wealth for the slaughtering’s is from what the deceased left for his inheritors and for orphans.
Even if the money for the slaughter and what is related to it was from other than his wealth and the wealth of the orphans, then indeed it wasn’t amongst the practices of the Prophet ﷺ and the Sahaabah and those after them, and the baab of Sadaqah is vast, but this is not from it in that situation.
They never used to slaughter and flaunt after the deceased ya’nee for three days and the likes of it, this is from the newly invented matters, and whoever is invited to that, he doesn’t cooperate on spreading this Munkar.
Rather he says to them this is incorrect, he reminds them about that, cooperating upon piety and Taqwa, and being present is an approval and cooperating if he doesn’t warn from it, he will be as a cooperater and approver, especially if he’s a caller to Allaah, so he doesn’t attend that because newly invented matters are from falsehood and a mistake;
(وَٱلَّذِينَ لَا يَشْهَدُونَ ٱلزُّورَ وَإِذَا مَرُّوا۟ بِٱللَّغْوِ مَرُّوا۟ كِرَامًا)
“And those who do not witness falsehood, and if they pass by some evil play or evil talk, they pass by it with dignity.” [Al-Furqaan: 72]
So the likes of these slaughterings whether it’s from the money of the orphans or inheriters without their permission or other than that, the evidence has not come for it so it’s to he avoided.
