Attaching an unknown matter to Divorce

Answered by our Shaykh, the ‘Allāmah, the Trustworthy Advisor, Abu ‘Abdirrahmān Yahya bin ‘Ali Al-Hajūri – may Allāh preserve him – on the 25th, Dhūl-Hijjah, 1441H

Question:

Attaching divorce to a unknown matter like saying to his wife you are divorced if I don’t marry a second wife, is it considered a divorce or does it take the ruling of an oath?

Answer:

No, it is a divorce;

إن الله تجاوز لي عن أمتي ما حدثت به أنفسها ما لم تعمل أو تتكلم

“Verily Allāh has pardoned my ummah for what the inner voice speaks with as long as they don’t put it into action or speak with it.”

If he says you are divorced if I don’t marry a second, if he doesn’t marry a second, one divorce falls upon his wife and upon him is to take her back.
