Is it permissible for the brother to marry off his sister if their father does not pray?

Answered by our Shaykh, the ‘Allaamah, the Sincere Adviser, Abu ‘Abdirrahman Yahya bin ‘Ali Al-Hajoori – may Allaah preserve him –

Question:

Is it permissible for the brother to marry off his sister if their father does not pray?

Answer:

If he is one who has abandoned the prayers, then a party from the people of knowledge have deemed him to be a kaafir, which is the correct opinion, so based upon that then the father is not to marry her off due to the saying of Allah:

“..وَلَنْ يَجْعَلَ اللهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا”

And never will Allah grant to the disbelievers a way (to triumph) over the believers. [An-Nisaa:141]

And due to the saying of Allah:

“وَالْمُؤْمِنُونَ وَالْمُؤْمِنَاتُ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ”
The believers, men and women, are Auliya’ (helpers, supporters, friends, protectors) of one another… [At-Taubah:71]

So the brother who prays is to marry her off, and the father who does not pray should not.
