Wearing Amulets From The Qurān

Question:

We know the scholars have declared amulets (even) if they are from the Qurān to be harām, but does it reach (the level of) minor shirk?.

Answer:

Yes, according to a number of scholars, it reaches (the level of) minor shirk based upon the well-known principle; ‘Taking as a means what is not a means’, so anything that is not a means – not established by the religion or proven amongst the people – but is taken as a means is indeed from shirk.

Even if these amulets are from the Qurān because Allāh and likewise His Prophet ﷺ did not make it a means in the religion or proven amongst the people and everything (taken as a means) that is not a means established by the religion or proven amongst the people is from minor shirk as long as it is not used in a way that raises it to major (shirk).

Some of them specifically mentioned it is from minor shirk because Allāh’s Messenger ﷺ used to break amulets and order for them to be broken, in fact, he would refrain from accepting the pledge of allegiance (of whoever had an amulet).

He would not say: ” Is this an amulet from the Qurān or an amulet not from the Qurān?” and ask for details, and not asking for details in a scenario where they are relevant means the statement applies generally (i.e. without exception).

He ﷺ would not ask: “Is this amulet upon you from The Qurān or not from The Qurān?” rather he would break them ﷺ, order for them to be broken, refrain from accepting the pledge of allegiance (of whoever had an amulet) and make his statements general:

[” مَنْ عَلَّقَ تَمِيمَةً فَقَدْ أشْرَكَ “.]
[“Whoever wears an amulet has indeed committed shirk.”] (1).

He did not say: “Whoever wears an amulet from other than The Qurān has indeed committed shirk”. His wording is general and therefore includes The Qurān and other than The Qurān.
