Marrying with the intention of not having kids
Question :
Is it permissible for a brother to marry a sister with the intention of not wanting to have kids with her?
And if so, is it permissible for the sister to have her tubes tied for this reason?
Answer :
The origin of the nikah (marriage) is to have kids after the marriage, so doing azl (temporarily preventing children) is one thing, but having the intentions of having no kids, that need to be look at, if the brother intentions is not have kids totally then that is haram.
On the other hand if the brother is hoping to have kids in the future then la bass, also azl is allowed to perform in this case.
As for the sister to tied up her tubes, no, this is haram, its not allowed in islam.
And proofs are available from the kitaab and sunnah, from those proofs Allah said in the Al-Quran:
“And do not kill your children because of a poverty, we will provide for you and them”, surah al an’am 151,
So from here what is clear from the ayah is that we shouldn’t kill our children, whether they have born or not as this is from the actions of the kuffar,and that Allah subhanahu wa ta’ala is the all provider.
And from the sunnah, hadith in Muslim regards to the creation of the slaves of Allah when Allah send’s the angle, who breathes the soul into the slaves, the angle write’s down four things,
– his provisions
– his lifespan
– his deeds
– his misery or happines
and Which is clear from the hadith is that Allah subhanahu wa ta’ala does whatever he wants so therefore we cannot try to stop from what Allah wills. We must refrain from doing a such action.
