Does the word Legislator apply to both Allah and the Prophet ﷺ

Question:

May Allah preserve you Oh Shaykh, is it permissible for us to use the word legislator upon the Prophet ﷺ?

Or is legislating specific to Allah alone?

May Allah reward you with good.

Answer:

The ‘Allāmah Ibn ‘Utheymīn, may Allah have mercy upon him, in “Mandhūmah Usūl Al-Fiqhi wa Qawā’idihi” said:

“[The basis in things is permissibility
       And prohibition in worship except with the permission of the Legislator]

The Legislator: is a description for Him, Exalted is He.
And the proof is statement of the Most High:

(شَرَعَ لَكُم مِّنَ ٱلدِّينِ)

“He (Allah) has legislated for you the same religion (Islam)”
[Ash-Shurā:13]

And the statement:

(لِكُلٍّ جَعَلْنَا مِنكُمْ شِرْعَةً وَمِنْهَاجًا)

“To each among you, We have prescribed a law and a clear way.”
[Al-Mā’ida:48]

But the scholars, may Allah have mercy upon them, say:
The word legislator is a descriptive word for Allah, and His Messenger ﷺ, because the Lord -the Mighty and Majestic- legislates, and the
Messenger ﷺ legislates.
And whatever the Messenger ﷺ legislates is the legislation of Allah.”
